These Terms of Service ("Terms") cover your use of panelboundcomics.com (the "Site") and every purchase you make from us. The Site is run by NguyenDistributorLLC, doing business as Panel Bound Comics (formerly Organic Priced Books) ("Panel Bound Comics," "we," "us," "our"). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy and SMS Terms. If you don't agree, please don't use the Site.
Please read Section 16. It says disputes are settled by individual arbitration, not in court, and that you give up the right to a jury trial or class action.
1. Who we are
We are an independent online store selling new comic books, graphic novels, omnibuses, collected editions and related merchandise. We buy our stock from publishers and distributors such as Penguin Random House. We are a reseller. We do not publish or own the books we sell.
2. Age and eligibility
You must be at least 18, or the age of majority where you live, to buy from us. A minor may use the Site only with a parent or guardian, who is responsible for the minor's purchases. Some titles are for mature readers. You decide whether a title is right for you or the person you are buying it for.
3. Your account
Keep your login private. You are responsible for activity under your account. We may suspend or close an account for fraud, abuse, chargeback abuse, harassing our staff, or breaking these Terms. If we close an account, we refund any orders that haven't shipped.
4. Orders and our right to cancel
Placing an order is an offer to buy. We accept it when we ship the item, not when you get a confirmation email. We may refuse, limit or cancel any order or item, for example because of availability, a pricing or listing error, quantity limits, suspected fraud or reselling, or a payment or shipping problem. If we cancel something you already paid for, we refund the full amount for that item with no fee.
5. Prices, payment and errors
- Payment. Every order, including pre-orders and back-orders, is charged in full at checkout.
- Prices are in U.S. dollars and can change before you order. A "compare at" price is the publisher's suggested retail price when we listed the item, shown for reference.
- Afterpay. If you pay with Afterpay, your installment plan is an agreement between you and Afterpay and is covered by Afterpay's own terms. Any refund on an Afterpay order goes back through Afterpay, which adjusts your installments.
- Errors. A price, title, format, cover, page count, description, release date or stock level can be listed wrong, sometimes because of data from a publisher or distributor. We may fix the error and cancel the affected order, even after you were charged, and refund you in full. We don't have to honor a price that was listed in error.
- Taxes and duties. You pay any sales tax, customs duties, import taxes and brokerage fees that apply.
- Promotions. Discount codes, rewards points, affiliate offers and sale prices follow their own stated terms. They can't be combined unless we say so, have no cash value, and can be changed or ended at any time.
6. Pre-orders
Publishers set release dates, covers, prices, page counts, contents and formats, and they can change any of these, sometimes more than once and by months. We aren't responsible for publisher delays or changes, but you can cancel a pre-order before it ships (see Section 8). Covers and descriptions shown before release come from the publisher's solicitation and may not match the final book. We update release dates by hand, so a date on the Site may lag behind the publisher's latest news. If a publisher cancels a title or we can't get enough copies, we cancel your pre-order for that item and refund you in full.
7. Back-orders
Back-ordered items are released titles we order from our distributor after you buy them. Please allow 2 or more weeks. If our distributor can't supply the item, we cancel it and refund you in full.
8. Cancelling an order
You can cancel any order or item, including pre-orders, back-orders, in-stock items and sale items, at any time before it ships. Once an order ships, it can't be cancelled. To cancel, email JP@panelboundcomics.com with your order number.
When you ask to cancel, you choose one of these:
- Refund to your original payment method, less a 10% cancellation fee on the amount refunded. The fee covers payment processing and handling costs we can't get back.
- Store credit for the full amount, with no fee. Store credit is added to your Panel Bound Comics customer account, has no cash value, can't be exchanged for cash except where the law requires, and does not expire.
No fee applies, and you get a full refund to your original payment method, when we cancel an order or item, when a publisher or distributor cancels a title or can't supply it, or when an item arrives damaged, missing or wrong.
Refunds to your original payment method usually take 4–5 business days to process after we issue them. Your bank or Afterpay may take longer to show it.
9. Shipping and delivery
Shipping options, costs and timing are in our Shipping Policy. Delivery dates are estimates. Ownership and risk of loss pass to you when we hand the package to the carrier. Problems with a package that has shipped are handled as described in our Shipping Policy, our Refund Policy, and the terms of any shipping protection you buy at checkout.
10. Returns and damaged items
All sales are final. We don't take returns or exchanges for change of mind. If something arrives damaged, defective, missing or wrong, tell us within 7 days of delivery as explained in our Refund Policy.
11. Product information and images
Product images, cover art, descriptions and specs come from publishers and distributors, or are adapted from their materials, so we can identify the products we sell. We try to keep them accurate, but colors, covers, sizes, page counts and contents can vary, and we can't promise every detail is correct or current.
12. Trademarks and our content
The Site's design, the text we wrote, our logo, the name "Panel Bound Comics," and our own photos and videos belong to us. Don't copy, scrape or reuse them without our written permission.
DC Comics, Marvel, Image Comics and all other publisher names, logos, characters and cover art belong to their owners. We are an independent retailer and are not affiliated with, endorsed by, or sponsored by any publisher unless we say so for a specific product. We use their names and images only to identify and describe the genuine products we resell. Reading orders, recommendations and guides on the Site are our own opinions.
13. Copyright complaints (DMCA)
If you believe something on the Site infringes your copyright, send a written notice to our copyright agent that includes: (1) your physical or electronic signature; (2) the copyrighted work you say is infringed; (3) the material you say is infringing and where it is on the Site, such as a URL; (4) your name, address, phone number and email; (5) a statement that you believe in good faith the use isn't authorized by the owner, its agent or the law; and (6) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

When we get a valid notice, we remove or disable the material promptly. If your material was removed and you believe that was a mistake, you can send a counter-notice to the same agent with: your signature; what was removed and where it was; a statement under penalty of perjury that it was removed by mistake or misidentification; your name, address and phone number; your consent to the jurisdiction of the federal court for your address (or the U.S. District Court for the Northern District of Texas if you are outside the U.S.); and your agreement to accept service from the person who sent the original notice. We may close the accounts of repeat infringers. Trademark and other complaints can go to the same contact.
14. Reviews and other content you post
You own the reviews, ratings, photos, wishlists and messages you send us. By posting them, you give us a free, worldwide, non-exclusive, permanent license to use, show, edit and share them on the Site and in our marketing. Only post content that is yours, truthful, legal and doesn't infringe anyone's rights. Don't post scans of interior comic pages or other copyrighted material you don't own. We may remove any content for any reason.
15. Warranties and our liability
To the fullest extent the law allows, the Site and everything on it are provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. Any product warranty comes from its publisher or manufacturer, not from us.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, lost profits, or loss of resale or collectible value, and our total liability for any claim is limited to the amount you paid us for the product the claim is about. Some places don't allow these limits, so some of them may not apply to you. Nothing here limits liability that can't be limited by law.
16. Disputes: informal first, then individual arbitration
Talk to us first. Before filing any claim, email us at JP@panelboundcomics.com, describe the problem, and give us 30 days to try to fix it.
Arbitration. If we can't resolve it, any dispute about these Terms, the Site or a purchase will be settled by final, binding, individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules, held in Johnson County, Texas, or by video or in writing if we both agree. Fees are paid as the AAA Consumer Rules provide. The Federal Arbitration Act applies to this section.
Exceptions. Either of us may bring an individual claim in small-claims court, or ask a court to stop misuse of intellectual property.
No class actions or jury trials. You and we may bring claims against each other only individually, not as part of any class, collective or representative action, and we both give up the right to a jury trial. If this waiver is found unenforceable for a claim, that claim goes to court instead of arbitration.
Opting out. You can opt out of arbitration by emailing us within 30 days of first accepting these Terms with your name, the email on your orders, and a clear statement that you opt out.
Time limit. Where the law allows, any claim must be brought within one year after it arises.
17. Indemnity
If a claim against us arises from your breaking these Terms, your posted content, your misuse of the Site or products, or your violation of a law or someone else's rights, you agree to cover our resulting losses and costs, including reasonable attorneys' fees.
18. Governing law and venue
These Terms are governed by Texas law, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Subject to Section 16, any court case must be brought only in the state or federal courts for Johnson County, Texas, and you agree to their jurisdiction.
19. Emails and text messages
If you opt in, we send order updates and marketing by email, and by text message under our separate SMS Terms. Signing up is never required to buy. Unsubscribe from email with the link in any email, or reply STOP to any text.
20. Rewards program
Our loyalty points program is covered by the Rewards Program Terms.
21. Other services and links
The Site uses outside services for payments (Shopify Payments and Afterpay), shipping and shipping protection, rewards, reviews, wishlists, customer support chat and email. It also links to outside sites, such as publisher pages. Those services and sites have their own terms, and we aren't responsible for them.
22. Changes to these Terms
We may update these Terms by posting a new version with a new "Last updated" date. Changes apply to orders placed and use of the Site after we post them.
23. General
These Terms and the policies linked above are the whole agreement between you and us about the Site. If a part is found unenforceable, the rest still applies. If we don't enforce a part, we haven't given it up. You can't transfer these Terms; we can. We aren't liable for delays caused by things outside our reasonable control, such as publisher or distributor delays, carrier disruptions, severe weather or natural disasters.
